Calyx CPA Webinar To Explain Split Tax Rules After Medical Cannabis Rescheduling

Webinar Details and Timing

Calyx CPA will host a free webinar on Monday, Nov.

EST, examining federal tax obligations for cannabis businesses now that the industry is divided between Schedule I and Schedule III.

Medical marijuana has been moved to Schedule III, while adult-use cannabis remains in Schedule I as the broader rescheduling proceeding continues. For companies operating in both markets, tax treatment has become more complicated.

Justin Botillier, CEO of Calyx CPA, will lead the session. He will provide a current update on federal rescheduling and explain how Internal Revenue Code §280E now applies differently to medical-only, adult-use-only and mixed-use cannabis businesses.

Calyx CPA serves operators across 30+ states, from single-location dispensaries to vertically integrated multi-state operations, as well as the emerging psilocybin service centers in Oregon. Interested participants can learn more at calyxcpa.com.

Section 280E Guidance and Priority Plan

§280E guidance now appears on the IRS 2026 2027 Priority Guidance Plan, though the plan sets no deadline for its release.

Because medical and adult-use cannabis now sit in different federal schedules, the same business can face different tax rules across its operations. The webinar will address how those distinctions affect deductions and tax treatment for each type of cannabis business.

Botillier will explain how the code section applies to medical-only, adult-use-only and mixed-use operators, helping attendees understand their current federal obligations.

Prior Year Taxes and Recovery Efforts

The webinar will also examine the continuing fight over prior-year §280E taxes. Botillier will address amended returns, refund claims, protective claims, statutes of limitation and developing litigation that could determine whether cannabis businesses can recover taxes previously paid on phantom income.

The session will explain the mechanisms available to businesses seeking refunds or protecting their claims, with statutes of limitation forming a key part of the discussion.

Ongoing court cases could shape whether those recoveries are possible.
